COSMETICS

KKB provides advice on the manufacture, labeling, and marketing of cosmetics in compliance with FDA requirements and other relevant laws and regulations. We counsel clients with regard to appropriate cosmetic claims and ingredients, the proper labeling of cosmetics (and products that are combinations of cosmetics and drugs or devices), substantiation requirements for claims, and safety issues. We additionally represent cosmetic manufacturers in disputes with competitors over advertising and promotional issues. On behalf of cosmetic manufacturers, we have negotiated with the FDA and the Federal Trade Commission (FTC), submitted formal comments to proposed FDA regulations, filed formal responses to agency enforcement initiatives, and represented clients in litigation involving both regulatory agencies and private litigants.
