Mr. Young joined Kleinfeld, Kaplan and Becker, LLP as a partner
in March 2003. He began his legal career in 1974 as an associate
and then partner at Wald, Harkrader & Ross. In 1986 he became
a partner in the firm now known as DLA Piper. He joined
Kleinfeld, Kaplan & Becker as a partner in March 2003. Mr.
Young graduated from Georgetown University Law Center in 1973 and
clerked on the District of Columbia Court of Appeals. He is the
co-author of the 1996 Food and Drug Law Institute book, Dietary
Supplement Health and Education Act: A Legislative History and
Analysis.
Mr. Young has counseled and represented domestic and foreign manufacturers
with respect to compliance and defense of matters under the statutes
enforced by the Food and Drug Administration, the Consumer Product
Safety Commission, the Federal Trade Commission, the Drug Enforcement
Administration and the Environmental Protection Agency for over
twenty-five years. He has a diversified litigation and legislative
consumer products practice from a regulatory, litigation and product
liability perspective.
Mr. Young represents food and dietary supplement product and ingredient
manufacturers, developers and distributors. He also represents
prescription drug developers, manufacturers and distributors and
medical device developers, manufacturers and distributors. Mr.
Young also represents other industries with respect to federal
regulatory matters.
Mr. Young serves as Regulatory Counsel to the Pharmaceutical Distributors
Association and represents several large secondary prescription
drug wholesalers with respect to matters arising under the Prescription
Drug Marketing Act and the Federal Food, Drug, and Cosmetic Act
and state laws implementing those statutes. Mr. Young serves as General Counsel to the American Herbal Products Association (AHPA). Mr. Young is a frequent lecturer at industry meetings on the implementation of DSHEA and counsels a number of dietary supplement companies with respect to compliance with the Federal Food, Drug, and Cosmetic Act.
Mr. Young counsels companies with respect to reporting and recall
obligations under the Consumer Product Safety Act (substantial
product hazard reporting) and the Federal Food, Drug, Cosmetic
Act (adverse event reporting and voluntary recalls). Mr. Young
has represented various regulated companies and trade associations
in consumer protection agency proceedings and in litigation.
Mr. Young represents companies in proceedings before the Federal
Trade Commission with respect to advertising substantiation and
compliance with the Federal Trade Commission Act.
Mr. Young has had extensive litigation experience, including as
one of the trial defense counsel in the nine month trial of the
Love Canal Landfill governmental litigation, United States v. Hooker
Chemical & Plastics Corp., 850 F. Supp. 993 (W.D.N.Y. 1994)
successfully defending claims by the State of New York for punitive
damages with respect to the company’s former hazardous waste
landfill in Niagara Falls, New York.
